Terms and Condition
The following terms and conditions (hereinafter referred to as the “Terms“) apply to users, visitors and all persons accessing the SOULME digital platform (hereinafter referred to as the “Application“).
By using or browsing this Application, you agree with and agree to be bound by the following Terms.
If you do not agree, please do not use this application.
Access to and use of the Application is at the user's own risk.
The following Terms have a contractual effect.
1. The following basic concepts are used:
Company: “Soul ME” LLC.
Sticker: A small piece of paper or cardboard designed by the Company that displays a QR code.
Service: Services for users to transfer video, audio or other materials to each other using Stickers of the Company through this Application.
User: A person who sends or receives video, audio or other material through the application.
2. Purchasing a service
In order to use the Service offered by the company, it is necessary to purchase a sticker with which the User can make videos, audio clips or other materials with the Application and send them to another person who, by scanning the QR code on the Sticker (Sticker) through the Application, receives the opportunity to watch this clip or material.
3. User behavior
When using the Application, the User may not upload, post, transmit, distribute or otherwise publish through the Application materials that are illegal, threatening, obscene, offensive, discriminatory, rude, defamatory, false, misleading, containing disrespectful language, sexual writing or graphic content and allusions to them, prevent any other person from using the Application, constitute or encourage behavior that could entail criminal or civil liability, or contain viruses or other harmful components, false or misleading indications about the origin or endorsement of facts.
The Company hereby has the right to remove any material that is deemed inappropriate in the above wording. By the way, in this case, the amount of the Services is not refundable.
4. Restrictions on the use of the application
We reserve the right to introduce certain restrictions and/or changes in the use of the Application without prior notice. The Company is not responsible for the temporary impossibility of using the Application or restricting access to it.
5. Responsibility
The Company may be liable for damages incurred by Users, up to the cost of the Stickers, if the damages incurred by the User are related exclusively to the improper provision of the Service by the Company.The Company is not responsible for any other direct or indirect damage incurred as a result of using the Application.
The Company is not responsible for temporary failures in the use of the Application, as well as for other temporary obstacles for the usage.
The Company does not bear any responsibility for the transfer of prohibited materials specified in paragraph 3 of these Terms.
6. Intellectual property
The Company owns all intellectual property rights to the Application and the materials contained therein. You may not use the Company's trademark, application design, available images or other copyrighted materials without the written permission of the Company.
In turn, the Company affirms to refrain from using videos or materials prepared by users without their permission.
7. Protection of personal data
The user gives his/her consent to the processing of his personal data.
Personal data is processed in accordance with the legislation of the Republic of Armenia and the strategy of the Company in order to provide the Services.
The user gives his consent to the transfer of his/her personal data by the Company to a third party, including the storage of information on servers/cloud outside the Republic of Armenia. When providing services, the Company may use the personal data of its users to inform them about new products, services, promotions or discounts of the Company.
The user can request information about the processing of his/her personal data, and their modification by sending an e-mail to the following address: info@soulme.am.
8. Changes to the terms
The Company has the right to change and update these Terms, which come into force after they are published in the Application, from the moment the User accesses the Application. When entering the application, the User is informed about the changes made to the Terms.
9. Applicable law
These Terms are governed by the laws of the Republic of Armenia. Any dispute is subject to interpretation from the point of view of the Republic of Armenia legislation and its resolution is subject to consideration exclusively by the competent courts of the Republic of Armenia.
